I understand this fee covers up to three (3) service attempts, and that I am paying for the attempts made, not a guaranteed successful service. An attempt is each separate visit to an address in pursuit of service, or each separate good faith effort to reach the subject at another location identified by Rocky Mountain Eagle Eye. If the subject is pursued at more than one address, each address visited counts as its own attempt, whether or not those visits happen on the same day or during the same trip.

When the work is complete, Rocky Mountain Eagle Eye returns the signed Return of Service affidavit to me through my client portal or by email. Filing it with the court is my responsibility, including e-filing it myself if I am registered for Colorado E-File. If I want Rocky Mountain Eagle Eye to file it for me, I can add Court Filing of Affidavit to my order for an additional fee.

Whether or not service is ultimately completed, if there is clear and convincing evidence to Rocky Mountain Eagle Eye, LLC, its agents, employees, and contractors that the subject is refusing or evading service, our sworn affidavit will state so. Any statements the subject made to the process server will be documented and filed with the court alongside it.

I confirm the name and address I provided are accurate and current to the best of my knowledge. I understand that fees are earned once the first attempt is made and are not refundable, including when the subject cannot be located, has moved, avoids service, or the address turns out to be incorrect or incomplete. Attempts at a different address require an additional address fee or a new order, and are available for addresses within 50 miles of Denver, Colorado. For an address farther out than that, I will reply to my order confirmation email and Rocky Mountain Eagle Eye will quote it. Skip trace service is available at additional cost if I need help locating the subject.

I understand that orders are worked in the order they are received and that Rocky Mountain Eagle Eye will move as quickly as it reasonably can. Timelines start when the documents to be served actually reach Rocky Mountain Eagle Eye, whether uploaded with this order, emailed, or hand delivered, not when the order is placed. Standard (5 business days), Rush (one to two business days), and Same Day (documents received before 10 AM on the requested date) describe when attempts begin, not a guaranteed completion date. Weather, gated or secured properties, incorrect addresses, and a subject actively avoiding service can extend the timeline.

I also understand that three attempts require enough time to be made. If I place an order close to my return date or court deadline, there may not be enough time to complete service before that deadline. If my deadline is near, I will state it in the special instructions and select Rush or Same Day. Rocky Mountain Eagle Eye is not responsible for a missed court deadline on an order placed without sufficient time to work it.

Client acknowledges and agrees that in the event Client initiates a chargeback or payment reversal through Client's card issuer, bank, or payment processor with respect to any charge for services rendered by Rocky Mountain Eagle Eye, LLC ("Company"), Client shall be responsible for an administrative fee equal to three (3) hours of administrative time at the Company's standard administrative rate of $135.00 per hour, totaling $405.00, regardless of the outcome of such chargeback or reversal. This fee compensates the Company for time expended documenting, responding to, and resolving the chargeback or reversal, and is in addition to any amounts owed for services rendered. Client agrees that this fee is a reasonable estimate of the administrative burden imposed by such actions and does not constitute a penalty. Nothing in this provision limits Client's right to raise billing questions or disputes directly with the Company, which the Company will address at no charge.
